How Does the UAE Gratuity Calculation Work?
Gratuity calculation in the UAE depends on several factors including your contract type, length of service, reason for leaving, and basic salary. Understanding these elements helps you know exactly what to expect.
The Official Formula
According to UAE Federal Decree-Law No. 33 of 2021, gratuity is calculated as follows:
For employees with less than 5 years of service:
- 21 days of basic salary for each year of the first 5 years
For employees with more than 5 years of service:
- 21 days of basic salary for each of the first 5 years
- 30 days of basic salary for each additional year beyond 5 years
Important Calculation Notes
Basic salary is used for calculations, not total salary. This means allowances like housing, transportation, and other benefits are typically excluded unless specified in your contract.
One day's wage is calculated as: Basic Monthly Salary ÷ 30
For incomplete years, gratuity is calculated proportionally based on the months worked. If you've worked 3 years and 7 months, you'll receive gratuity for 3 full years plus 7/12 of the fourth year.
Resignation vs. Termination
If you (leave voluntarily):
- Less than 1 year: No gratuity
- 1-3 years: One-third of total gratuity
- 3-5 years: Two-thirds of total gratuity
- More than 5 years: Full gratuity
If you're or on an unlimited contract that expires naturally, you receive full gratuity regardless of service duration (provided you've completed at least one year).
Similar to how our end of service benefits tool works, accurate inputs lead to precise calculations.
PRACTICAL EXAMPLES
Practical Gratuity Calculation Examples
Let's look at real-world scenarios to understand how gratuity calculations work for different situations across the UAE.
Example 1: Marketing Manager in Dubai Marina (Completed Contract)
Scenario: Sarah worked as a Marketing Manager at a tech company in Dubai Marina for 6 years and 8 months. Her limited contract ended naturally.
Details:
- Basic Salary: AED 15,000 per month
- Service Duration: 6 years and 8 months
- Reason for leaving: Contract completion
Calculation:
- Daily wage: AED 15,000 ÷ 30 = AED 500
- First 5 years: 21 days × 5 years = 105 days
- Next 1 year and 8 months: 30 days × 1.67 years = 50.1 days
- Total days: 105 + 50.1 = 155.1 days
- Total Gratuity: AED 500 × 155.1 = AED 77,550
Result: Sarah receives AED 77,550 as her full gratuity payment since her contract ended naturally.
Example 2: Sales Executive in Abu Dhabi (Resignation)
Scenario: Ahmed worked as a Sales Executive at a retail company in Abu Dhabi for 4 years and 2 months before resigning for a better opportunity.
Details:
- Basic Salary: AED 8,000 per month
- Service Duration: 4 years and 2 months
- Reason for leaving: Voluntary resignation
Calculation:
- Daily wage: AED 8,000 ÷ 30 = AED 266.67
- Total service: 21 days × 4.17 years = 87.57 days
- Full gratuity: AED 266.67 × 87.57 = AED 23,352
- Since service is between 3-5 years: Two-thirds entitlement
- Actual Gratuity: AED 23,352 × 2/3 = AED 15,568
Result: Ahmed receives AED 15,568 (two-thirds of full gratuity) because he resigned before completing 5 years.
Example 3: Accountant in Sharjah (Early Resignation)
Scenario: Fatima worked as an Accountant in Sharjah for 2 years and 9 months before relocating abroad.
Details:
- Basic Salary: AED 12,000 per month
- Service Duration: 2 years and 9 months
- Reason for leaving: Voluntary resignation
Calculation:
- Daily wage: AED 12,000 ÷ 30 = AED 400
- Total service: 21 days × 2.75 years = 57.75 days
- Full gratuity: AED 400 × 57.75 = AED 23,100
- Since service is between 1-3 years: One-third entitlement
- Actual Gratuity: AED 23,100 × 1/3 = AED 7,700
Result: Fatima receives AED 7,700 (one-third of full gratuity) as she resigned between 1-3 years of service.

IMPORTANT INFORMATION
What Counts as Basic Salary?
Basic salary is the fixed amount specified in your employment contract, excluding allowances. Housing allowance, transportation, mobile allowance, and other benefits are not included in gratuity calculations unless your contract explicitly states otherwise.
Some companies in DIFC and ADGM follow different regulations, so always verify your employment zone.
Special Situations
Termination for Misconduct: If you're terminated due to serious misconduct under Article 120 of UAE Labour Law, you may lose your gratuity entitlement entirely. This includes actions like assault, fraud, or violating safety regulations.
Maternity-Related Resignation: Female employees who resign within 6 months of childbirth are entitled to full gratuity, regardless of years of service, provided they've completed at least one year.
Unlimited Contracts: The same gratuity rules apply whether you're on a limited or unlimited contract. The key difference is in the resignation penalties, not the calculation method.
Common Mistakes to Avoid
- Including total salary: Many employees incorrectly include allowances. Always use basic salary only.
- Miscounting service years: Service is calculated from your actual start date, not visa issue date or probation end date.
- Forgetting partial years: Even 6 months of service in a year counts proportionally toward your gratuity.
- Not keeping documentation: Always maintain copies of your contract, salary certificates, and service letters.
Expert Tips
Request a gratuity certificate from your employer when leaving. This official document confirms the amount paid and protects both parties from future disputes.
Gratuity must be paid within 14 days of your last working day according to UAE law. If delayed, you have the right to file a complaint with MOHRE.
